Terms of Use
Last updated: 14 October 2026
These Terms of Use (“Terms”) govern your use of Kabisa — including Kabisa Documents, Kabisa Marketplace, related WhatsApp and website tools — operated by DataFly Ltd (“Kabisa”, “we”, “us”). By creating an account, paying for a service, listing on Marketplace, or otherwise using Kabisa, you agree to these Terms.
If you do not agree, do not use Kabisa. Questions: info@kabisa.co.ke · Tel +254 141 769 211.
1. Who we are
Kabisa is a product of DataFly Ltd, Nairobi Pentecostal Bible College, 2nd Floor, Suite 23, Garden Estate Road, Thome, Nairobi, Kenya. Kabisa helps Kenyan businesses prepare professional documents and connect buyers with providers on Marketplace.
2. Accounts and eligibility
- You must be able to enter a binding contract under Kenyan law and use an accurate phone number you control.
- Business accounts must represent a real business you are authorised to operate.
- You are responsible for activity on your WhatsApp number and web sessions linked to your account.
- We may suspend or restrict accounts that appear abusive, fraudulent, or in breach of these Terms.
3. Kabisa Documents
- Documents (invoices, quotations, receipts and similar) are prepared from information you provide.
- You are responsible for the accuracy of prices, quantities, customer details and tax treatment.
- Previews may be free; generating or revising issued documents may attract the fees shown at the time of payment.
- Kabisa is a business tooling service — it is not your accountant, lawyer or tax authority.
4. Kabisa Marketplace
- Buyers may browse listings. Sending enquiries to providers may use a free allowance and may require verification.
- Providers receive short opportunity notices. Accepting an enquiry may debit the published lead fee (currently KES 10) from the provider wallet. Declining is free.
- After a provider accepts and the buyer has consented, Kabisa may share contact details and open a handoff to the provider’s own WhatsApp. Ongoing negotiation happens between buyer and provider.
- Kabisa does not guarantee a sale, quote quality, delivery, or payment between buyers and providers.
- Existing registered Kabisa businesses may add Marketplace free where eligibility rules apply; new Marketplace activations may pay the published setup fee.
5. Fees and payments
- Prices are shown in Kenya Shillings on the website and WhatsApp flows. The live system charge is authoritative.
- Payments are typically collected via M-Pesa or other methods we enable. Wallet balances are used for eligible charges such as Marketplace lead unlocks.
- Fees for completed document generation and accepted Marketplace leads are generally non-refundable once the service has been delivered, except where required by law or where we confirm a clear billing error.
- We do not introduce new buyer Marketplace enquiry fees without clear disclosure and, where applicable, an explicit opt-in.
6. Acceptable use
You must not use Kabisa to:
- Spam, harass, defraud, or mislead buyers or providers
- Submit duplicate or abusive Marketplace enquiries to exhaust provider notifications
- Upload unlawful, infringing or harmful content
- Attempt to bypass security, quotas, payments or access controls
- Impersonate another person or business
7. Content and intellectual property
- You retain rights to your business content (logos, slogans, customer lists you upload).
- Kabisa and DataFly Ltd retain rights to the platform, software, branding and documentation.
- You grant us a limited licence to process your content only as needed to provide the service (for example generating PDFs and matching Marketplace requests).
8. Availability
We aim for reliable service but do not warrant uninterrupted availability. WhatsApp, Meta, M-Pesa and other third parties can affect delivery. Planned maintenance or incidents may temporarily limit features.
9. Liability
- Kabisa is provided on an “as available” basis for business use.
- To the fullest extent permitted by Kenyan law, we are not liable for indirect or consequential losses, lost profits, or disputes purely between buyers and providers.
- Our aggregate liability for a claim relating to paid services is limited to the fees you paid to us for the specific service giving rise to the claim in the 90 days before the claim.
- Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
10. Privacy
How we collect and use personal data is described in our Privacy Policy. By using Kabisa you acknowledge that policy.
11. Changes
We may update these Terms. Material changes will be reflected on this page with an updated date. Continued use after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of Kenya. Courts in Nairobi have non-exclusive jurisdiction, without limiting any mandatory consumer protections that apply.
